If your house needs work and you have been told it will not sell until you fix it, that is not quite true. You can sell a house as-is in California. What changes is who buys it, how fast it closes, and what you are expected to do before closing day.

What As-Is Actually Means in California

Selling as-is means you are selling the property in its current condition and you are not agreeing to make repairs. The buyer accepts the house the way it stands. It does not mean the sale is unconditional, and it does not mean the buyer is blind to problems.

Here is the part that surprises people. In California, selling as-is does not remove your duty to disclose. State law requires most residential sellers to complete a Real Estate Transfer Disclosure Statement, and you still have to tell the buyer about known material defects. As-is limits what you have to repair. It does not limit what you have to reveal.

That distinction protects you. A buyer who knows about the foundation crack before closing cannot come back later claiming they were misled. Disclosure is what makes an as-is sale final.

What You Do Not Have to Do

  • You do not have to paint, clean, stage, or haul anything away
  • You do not have to hold showings or open houses
  • You do not have to fix items an inspector flags

You can leave what you do not want. Furniture, appliances, whatever is in the garage. Most sellers are surprised by that one.

The Two Ways to Sell As-Is

List It As-Is on the Open Market

You can list an as-is property with an agent. It works, but there are trade-offs worth knowing. Most buyers on the open market are financing the purchase, and lenders have opinions about condition. If the house has an active roof leak, missing flooring, or a non-working water heater, an appraiser can flag it and the loan can stall. You may end up making the repair anyway, just later and under pressure.

You will also pay commissions, typically around five to six percent split between both sides, plus closing costs. On a slow sale you carry the mortgage, insurance, taxes, and utilities the whole time.

Sell Directly to a Cash Buyer

A cash buyer is not getting a loan, so there is no appraisal to satisfy and no underwriter deciding whether your house qualifies. Condition stops being an obstacle because the buyer is planning to do the work themselves.

The trade-off is honest and worth stating plainly. A cash offer on a house that needs significant work will come in below what a fully renovated version of the same house would fetch. You are trading some price for speed, certainty, and not having to fund repairs you may not be able to afford. For some sellers that is the wrong trade. For others it is the only one that works.

When As-Is Makes the Most Sense

  • The repairs cost more than you have available
  • You inherited the property and live somewhere else
  • The house is vacant and you are carrying it every month
  • You are on a deadline, whether that is a job, a divorce, or a foreclosure date
  • You simply do not want to manage contractors for three months

Do Not Skip These Two Things

Get the offer in writing with the terms spelled out. Who pays closing costs, what the closing date is, and whether the offer depends on anything. A serious buyer will put it on paper without being asked.

Use a licensed title company or escrow. This is where title gets checked, liens surface, and the money actually changes hands safely. Anyone who wants to avoid escrow is telling you something.
